September 2020:  China's Judicial Review of Arbitration: Cases and Statistics

A key aspect of the arbitration regime in China and any other jurisdictions is that arbitration proceedings are subject to certain judicial review conducted by national courts in one way or another.  In this newsletter, TianTong’ cross-border dispute resolution team provides an analytical and statistical perspective on the basis of judicial review cases of commercial arbitration in China.  In particular, four issues that are frequently encountered in judicial review of commercial arbitration before Chinese courts are addressed, including: (i) the validity of arbitration agreements, (ii) setting-aside of domestic arbitral awards, (iii) enforcement of Chinese arbitral awards and (iv) recognition and enforcement of non-Chinese arbitral awards.  As always, the newsletter also features recent Chinese law updates.
