In this newsletter, TianTong’s cross-border dispute resolution team shares a view on two questions related to the judicial review of arbitration agreements under Chinese law, namely, whether Chinese courts have jurisdiction to decide whether an arbitration agreement is duly formed in assessing the validity of an arbitration agreement, or whether they have jurisdiction to hear a case where a party requested the Chinese court to confirm the validity of an arbitration agreement.  The featured article summarises Chinese courts’ split views on the two questions.  Recent updates on Chinese law are also provided.
